The first person to use a trademark in Canada has the right to both use the trademark and prevent the registration of confusingly similar trademarks.  Once you have begun to use a trademark, you have the right to register the mark (whether or not you register it at the time of the first use) provided that there is no other use of the trademark, or a confusingly similar one.
